Terms of use

Last updated: March 22, 2026

Welcome to ChatCheckly. These Terms of Use ("Terms") govern your access to and use of our website, applications, and related services (the "Service") operated by the team behind ChatCheckly. Our Privacy Policy explains how we handle personal data. Together, these documents form your agreement with us. If you do not agree, please do not use the Service.

1. The Service

ChatCheckly helps YouTube creators and teams work with comments—for example by exporting comments, running giveaways with a random picker, and (for signed-in users) analyzing sentiment, topics, and engagement in a dashboard. Features available to you depend on your plan and account status. We may add, change, or discontinue features with reasonable notice where appropriate.

The Service depends on third-party platforms (including Google, YouTube, and payment providers). We are not responsible for those platforms' availability, policies, or changes they make to their APIs or terms.

2. Eligibility and accounts

You must be old enough to enter a binding contract where you live. When you create or use an account (including through Google sign-in), you agree that your information is accurate and that you will keep it updated. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.

3. Acceptable use

You agree not to:

  • Use the Service in violation of law or third-party rights.
  • Attempt to scrape, overload, disrupt, or gain unauthorized access to our systems or data.
  • Use the Service to harass, harm, or spam others, or to distribute malware.
  • Circumvent rate limits, billing, or technical restrictions, or resell the Service without our written permission.
  • Use the Service in any way that violates YouTube API Services User Data Policy or other applicable YouTube or Google requirements.

We may suspend or terminate access if we reasonably believe you have breached these Terms or pose a risk to the Service or other users.

4. Your content and YouTube data

You retain rights to content you submit or that originates from your channels, subject to YouTube's and Google's terms. You give us permission to host, process, transmit, and display such content only as needed to provide the Service to you. You represent that you have the rights necessary for us to process the data you instruct us to fetch or analyze. AI-generated outputs are provided for your convenience and may be imperfect; you remain responsible for how you use them.

5. Subscription plans and pricing

We offer free and paid plans. Current features and prices are described on our Pricing page. We may change prices or plans; when changes affect existing subscriptions, we will provide notice as required by law or as stated at checkout.

6. Billing and payments

Paid subscriptions are billed through Stripe. You authorize us and Stripe to charge your chosen payment method. You are responsible for applicable taxes. We do not store your full payment card details on our servers; Stripe processes payments subject to its terms and privacy policy.

Auto-renewal: Unless you cancel before the renewal date, subscriptions renew for the same period at the then-current rate.

7. Cancellation and changes

You may cancel your paid subscription through the flows we provide (for example in billing settings or via Stripe customer portal, when available). Cancellation typically takes effect at the end of the current billing period, and you retain access until then unless we state otherwise. Downgrades may reduce access to certain data or features consistent with the new plan.

8. Refunds

Unless a different policy is expressly stated on our website or at checkout, fees are generally non-refundable except where required by applicable law. If we offer a voluntary refund or guarantee, the details on our Pricing page or checkout flow will control.

9. Right of withdrawal (EEA, UK, and similar)

If you are a consumer in a jurisdiction that grants a statutory right to withdraw from distance contracts, you may have the right to withdraw within the period specified by law. If you request that we begin performing the Service during that period, you may owe a reasonable amount for the part already provided. Statutory rights are not limited by this summary; see any withdrawal information we provide at purchase where required.

10. Intellectual property

The Service, including its branding, software, and documentation, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited rights granted in these Terms, we reserve all rights. Feedback you provide may be used without obligation to you.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE OR SUITABLE FOR ANY DECISION.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER CHATCHECKLY NOR ITS SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM OR (IF GREATER) FIFTY US DOLLARS (USD $50), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

13. Indemnity

You will defend and indemnify us against claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your content, or your violation of these Terms or applicable law, to the extent permitted by law.

14. Communications

We may send transactional and service-related messages (such as receipts, security notices, and product updates). If we send optional marketing communications, we will provide a way to opt out where required by law.

15. Changes to these Terms

We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. If a change is material, we will provide additional notice as appropriate (for example by email or in-product notice). Continued use after the effective date constitutes acceptance of the revised Terms where permitted by law.

16. Governing law and disputes

Unless mandatory consumer protection rules in your country require otherwise, these Terms are governed by the laws applicable to the operator of ChatCheckly, without regard to conflict-of-law rules. Courts in that jurisdiction may have exclusive venue, except that consumers may have non-waivable rights to sue in their home courts.

17. Contact

For questions about these Terms, contact us through the contact method we provide on the Service.
